Australia extended a mixed-purpose small-business lending exemption to 2036. Sole-trader hairdressers should understand the lower protection before combining business and personal borrowing.
Abby's take
What this means for the industry — and for independents
Industry impact. The National Consumer Credit Protection Amendment (Small Business Exemption) Regulations 2026 commenced on 5 September and moved the exemption end date to the start of 3 October 2036. It continues a lower-friction pathway for certain mixed-purpose small-business loans.
For freelancers. Sole traders often blur business and personal cash because the legal borrower is the individual. A loan funding both a freelance setup and household costs can fall into a different protection framework from the consumer loan the borrower assumes they are getting.
My take. Easy approval is not the same as safe finance. I would separate the business purpose line by line, price the repayment against a quiet booking month and understand every guarantee or secured asset before signing. If the move only works by hiding living costs inside the loan, the plan needs another look.
What I'd do next
- Write a purpose schedule showing the exact dollar amount for equipment, fit-out, workspace, stock, tax, refinancing and personal spending before speaking with a lender or broker.
- Ask in writing whether the proposed credit is treated as consumer, commercial or exempt mixed-purpose lending and which responsible-lending assessment and dispute pathway applies.
- Compare the annual percentage rate, establishment and broker fees, total repayments, variable-rate exposure, early-repayment terms, security and personal guarantees across offers.
- Model repayments against a normal month and a month with lower bookings, then keep enough buffer that the first cancelled week does not create a default problem.

What changed and when
The Federal Register of Legislation records the 2026 small-business exemption regulation as in force. It commenced on 5 September 2026 and replaced the former end date so the exemption period now ends at the start of 3 October 2036.
The extension matters now because the previous expiry date has passed. It does not create an entitlement to credit, set a fair interest rate or certify that a loan is affordable. It changes how certain responsible-lending obligations can apply to mixed-purpose small-business credit.
The mixed-purpose problem for a sole trader
Consumer credit laws generally focus on personal, domestic or household credit. The small-business exemption can affect a loan with a genuine business purpose that is not minor or incidental, even when part of the money also has a personal purpose.
Consider a hypothetical $30,000 loan: $18,000 for equipment and workspace setup, $4,000 for opening stock and $8,000 for rent and household bills during the move. The label on the application is not enough. The purpose, exemption criteria and lender documents determine the treatment, so the borrower should obtain advice before combining those needs.
Lower friction can mean lower protection
ASIC says commercial loans receive the lowest level of legal protection and that this limits its ability to act in individual commercial-loan disputes. General protections may still prohibit unconscionable conduct, misleading conduct and unfair contract terms, but a court sets a high bar in a commercial context.
Do not hear 'small-business exemption' as 'government-approved loan'. It may mean some consumer responsible-lending checks do not apply. The borrower therefore needs to do more of the suitability work independently.

Separate the loan purpose before comparing rates
List each use of funds and ask whether it produces business capacity, replaces an existing liability or covers personal living costs. A single blended figure hides which part can repay itself and which part depends on drawings from future revenue.
Where practical, compare a clearly documented business facility with separate treatment for personal needs. Keep quotations, invoices and the approved purpose schedule. Using funds outside the documented purpose can create contractual, tax and dispute problems.
Price the default, not only the repayment
A weekly or monthly repayment is incomplete without the establishment fee, broker fee, interest over the term, late fees, default rate, early-exit cost and any asset or personal guarantee at risk. Ask what happens after one missed payment and what the lender can enforce.
Run the calculation with bookings 25 per cent below forecast and include GST, product, workspace, insurance and tax reserves before debt service. Finance that works only in the best month is not funding resilience; it is borrowing against optimism.

A five-question signing gate
Before accepting, answer five questions in writing: What exact purpose does each dollar serve? Which credit protections apply? What is the total amount repayable? What property or guarantee is exposed? What is the exit plan if bookings remain below forecast for three months?
If the lender or broker cannot answer clearly, pause. Independent legal advice on the documents and financial advice on affordability cost less than discovering the classification, security and default rights after the business is under pressure.

Common questions
What did the 2026 small-business lending regulation change?
The in-force regulation moved the end of the mixed-purpose small-business exemption period to the start of 3 October 2036. It commenced on 5 September 2026.
Does the exemption mean a lender must approve my business loan?
No. It does not require approval, set the price or establish that the loan is suitable. Lenders retain their own credit criteria and borrowers should independently assess cost, terms, security and repayment capacity.
Are commercial loans protected by responsible-lending laws?
The answer depends on the loan and purpose. ASIC says commercial loans generally receive a low level of legal protection, while some general protections still apply. Ask the lender which regime covers the proposed facility and obtain advice.

Approval answers the lender’s question, not yours.
Your question is whether the business can repay the complete cost without putting essential personal assets or the next quiet month at unacceptable risk.
